FAQs on Patents

A Patent is an exclusive right granted for an invention, which is a product or a process that provides a new way of doing something or offers a new technical solution to a problem.

Generally, a utility patent is valid for 20 years from the date of filing the application, provided that renewal fees are paid periodically.

To be patentable, an invention must be Novel (new), Non-obvious (not an obvious step to an expert), and have Industrial Utility (must be useful).

A Utility Patent protects the way an invention works or is used, while a Design Patent protects the ornamental or aesthetic appearance of an item.

A provisional application allows you to establish an early priority date (filing date) and use the term "Patent Pending" for 12 months while you refine your invention.

The process is longer than trademarks, typically taking 2 to 5 years depending on the complexity of the invention and the examination process.

Patents are territorial. To protect your invention globally, you can use the PCT (Patent Cooperation Treaty) to file a single international application to seek protection in many countries.

If the examiner issues an objection, we can file a response/amendment to address the concerns or appeal the decision to a higher authority.

A Patent protects functional inventions and processes, while Copyright protects original artistic, musical, or literary works.

A Prior Art Search is essential to ensure your invention is actually new and not already patented by someone else, saving you time and expensive filing fees.
