What is Design? Why get a design registered?

A design means the features of shape, configuration, pattern, ornament or composition of lines or colours applied to any article whether in two dimensional or three dimensional or in both forms, by any industrial process or means, whether manual, mechanical or chemical, separate or combined, which in the finished article appeal to and are judged solely by the eye; but does not include any mode or principle of construction or anything thing which is in substance a mere mechanical device, and does not include any trademark.

Design gives a product an aesthetic appeal and often also helps to distinguish between products. It is an asset of a firm and therefore needs to be protected like other forms of intellectual property.However it must be noted that registered designs are intended to protect the appearance of products not their function.

  • Name, address and nationality of the applicant
  • Five copies of each pose of drawings, photographs, tracings of specimens (as the case may be)
  • Name of article or articles to which the design is to be applied
  • Power of Attorney
  • Details of first application (if any) in any convention country:-
    • Name of Country
    • Priority date
    • Priority number
